1. INTERPRETATION AND DEFINITIONS

The definitions below apply whether terms appear in singular or plural form.

1.2 Definitions

For the purposes of these Terms and Conditions:

  • "Company" (also referred to as "GL Technologies," "We," "Us," or "Our") refers to GL Technologies, India, the entity that operates ArchSynth.
  • "Country" refers to India.
  • "Device" means any device capable of accessing the Service, including but not limited to computers, mobile phones, and tablets.
  • "Service" refers to the website ArchSynth ("Website"), accessible at https://archsynth.com.
  • "Terms and Conditions" (also referred to as "Terms") constitute the legally binding agreement between You and the Company governing the use of the Service.
  • "Third-party Social Media Service" refers to any services or content (including data, information, products, or services) provided by a third party that may be displayed, included, or made available through the Service.
  • "You" refers to the individual accessing or using the Service, or the legal entity on behalf of which such individual is accessing or using the Service, as applicable.

2. ACCEPTANCE OF TERMS

By accessing or using the Service, You acknowledge that You have read, understood, and agree to be legally bound by these Terms. If You do not agree with any part of these Terms, You must refrain from accessing or using the Service.

You represent and warrant that You are at least 18 years old. The Company does not permit individuals under the age of 18 to use the Service.

Your access to and use of the Service is also subject to Our Privacy Policy, which explains how We collect, use, and disclose Your personal information. You must review and accept the Privacy Policy before using the Service.

3. CANCELLATION AND REFUND POLICY

3.1 Cancellation Policy

Users may cancel their subscription or purchase at any time via the ArchSynth billing portal. However, cancellation does not automatically entitle the user to a refund. Refund eligibility is governed by the Refund Policy below.

3.2 Refund Policy

  • Users who cancel their subscription within seven (7) days of purchase are eligible for a full refund.
  • Refund requests made beyond this period will not be honored, except as required by law or as determined by ArchSynth in extraordinary circumstances at its sole discretion.
  • Refunds will be processed in accordance with the original payment method, subject to potential delays caused by financial institutions or third-party payment processors.
  • For EU users: A 14-day cooling-off period applies if required by applicable consumer protection laws.

4. INTELLECTUAL PROPERTY RIGHTS

4.1 Ownership of Assets

  • You retain full ownership of all assets You create using the Service, subject to applicable intellectual property laws.
  • If You use public assets, remix, or upscale content created by others, ownership remains with the original creator.
  • If You cancel or downgrade Your membership, You retain ownership of previously created assets, but certain features may no longer be available.

4.2 Rights Granted to ArchSynth (Public Content)

  • If You use the Service with public privacy settings, You grant ArchSynth a worldwide, non-exclusive, sublicensable, royalty-free, revocable license to use, reproduce, create derivative works from, publicly display, sublicense, and distribute the text and image prompts You input into the Service, along with any assets created.
  • You may revoke this license by explicitly removing Your public content.

4.3 Use of Public Renders

By making images public via Our Service, You grant ArchSynth the right to use them for promotional purposes, including marketing materials, social media, and website content.

5. UNLIMITED SERVICE AND RATE LIMITING

  • Users on an "unlimited" plan receive reasonable access to the Service.
  • ArchSynth reserves the right to impose fair usage limits to maintain service quality for all customers.
  • Any limits will be transparently communicated and applied fairly.

6. TERMINATION

We reserve the right to suspend or terminate Your access to the Service at Our sole discretion, without prior notice, if You breach these Terms.
Upon termination, Your right to use the Service immediately ceases.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • Our total liability under these Terms shall not exceed the greater of (i) the amount You paid for the Service or (ii) USD 100.
  • Under no circumstances shall ArchSynth be liable for incidental, indirect, or consequential damages, including loss of profits, data, business interruption, or personal injury.
  • Some jurisdictions do not allow certain liability limitations. In such cases, Our liability shall be limited to the maximum extent permitted by applicable law.

8. DISCLAIMER OF WARRANTIES

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, whether express or implied. We do not guarantee that:

  • The Service will be uninterrupted or error-free.
  • Any errors or defects will be corrected.
  • The Service is free from viruses or malware.

9. GOVERNING LAW AND DISPUTE RESOLUTION

  • These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
  • Dispute Resolution: If You have a dispute concerning the Service, You agree to first attempt an informal resolution by contacting Us. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of India.
  • For EU users: You shall benefit from any mandatory legal provisions applicable in Your country of residence.

10. CHANGES TO THESE TERMS

  • We reserve the right to modify or replace these Terms at Our sole discretion.
  • Material changes require 30 days’ notice.
  • Users must actively accept material changes before they take effect.
